1. Acceptance of Terms

By accessing our website, submitting an inquiry, signing an estimate or contract, or authorizing work to begin, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. These Terms apply to all visitors, customers, and users of our Site and services.

2. Description of Services

Mansfield Asphalt Paving is an asphalt paving contractor offering services that include, but are not limited to: asphalt paving, sealcoating, parking lot striping, driveway paving, asphalt repair, crack sealing, asphalt resurfacing, pothole repair, grading and excavation, concrete curbing, drainage solutions, and related paving services in Mansfield, TX and surrounding communities.

We reserve the right to decline any service request at our discretion. Our services are available to residential and commercial customers in our service area. Service availability may vary based on location, project size, and scheduling.

3. Estimates and Pricing

Any estimate we provide is based on the information available at the time of assessment. Estimates are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a binding contract until a written agreement is signed by both parties.

Prices may change if the scope of work changes, site conditions differ materially from what was assessed, or unforeseen issues arise during the project (such as hidden base failure, utility conflicts, or soil conditions that require additional preparation). We will notify you of any required scope or price changes before proceeding with additional work.

We do not guarantee any specific resale value, return on investment, or property value increase as a result of our work. Any statements about improved curb appeal or general property maintenance are informational only.

4. Scheduling and Cancellation

Once a project is scheduled, we ask that you provide at least 48 hours notice if you need to cancel or reschedule. We reserve the right to reschedule work due to weather conditions, equipment issues, or other circumstances outside of our control. We will notify you as promptly as possible if we need to change a scheduled date.

You are responsible for ensuring that the work area is accessible on the scheduled date. This includes removing vehicles, clearing obstructions, and informing any relevant parties (such as an HOA or neighbor) of the work. Delays caused by inaccessible or unprepared sites may result in rescheduling and could affect pricing.

If a deposit has been paid and you cancel without sufficient notice as defined in your written agreement, the deposit may be partially or fully non-refundable depending on the costs already incurred.

5. Payment Terms

Payment terms will be specified in your written project agreement. We typically require a deposit at the time of signing, with the balance due upon project completion unless otherwise agreed in writing. We accept payment by check, cash, or other methods specified in your agreement.

All invoices are due upon receipt unless a different payment schedule is set out in your agreement. Overdue balances may be subject to late fees as specified in your agreement and as permitted by applicable law.

If payment is not received after a reasonable period following project completion, we reserve the right to pursue all available legal remedies to collect the outstanding balance, including the filing of a mechanic's lien on the property in accordance withTexas law.

6. Warranty

We stand behind the quality of our work. Any warranty terms will be specified in your written project agreement. General warranty coverage applies to defects in workmanship under normal use and conditions.

Warranty coverage does not apply to damage caused by: acts of nature (including flooding, extreme weather events, or freeze-thaw cycles beyond normal seasonal variation), third-party actions, misuse, modification of the work by anyone other than us, underlying soil conditions beyond what was identified during site assessment, or failure to follow post-installation care instructions provided at the time of project completion.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all implied warranties regarding the website itself, including fitness for a particular purpose and non-infringement.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Mansfield Asphalt Pavingshall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our Site or our services, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for any claim related to our services exceed the amount you actually paid to us for the specific project giving rise to the claim.

8. Intellectual Property

All content on this Site - including text, images, logos, and other materials - is the property of Mansfield Asphalt Paving and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written consent.

9. Dispute Resolution

If a dispute arises between you and Mansfield Asphalt Paving related to these Terms or our services, we ask that you first contact us directly so we can attempt to resolve the matter informally. Most issues can be resolved with a direct conversation.

If informal resolution is not possible, disputes will be resolved through binding arbitration in Mansfield, TX, in accordance with the rules of a mutually agreed arbitration provider, unless otherwise required by applicable law. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

10. Governing Law
